The former personal attorney for Donald Trump has resigned as New Jersey's top federal prosecutor. This follows a legal ruling that challenged her right to hold the office.

Attorney General's Statement

US Attorney General, Pam Bondi, confirmed the prosecutor's departure on the start of the week. She commented that the judicial decision made it impossible for her to effectively run her office.

"But do not mistake adherence to the ruling as defeat," she wrote. "My fight will now reach across the nation."

Judicial Challenge

The departure comes a week after a federal appellate panel ruled that she had been acting without proper authority as the top prosecutor. This decision is likely to affect many prosecutions in the Garden State.

The court ruled that a acting appointment that bypassed the advice and consent of the Senate breached the Federal Vacancies Reform Act.

Ongoing Legal Battle

It was also stated that the former prosecutor will continue working within the Department of Justice as a top consultant. They intend to challenge the decision of the ruling, aiming for a overturned decision.

Writing online, Bondi wrote that the court "should not be able to countermand the President's choice of attorneys responsible for performing the executive branch's core responsibility of enforcing the law."

She highlighted the prosecutor's work and said that while she was in charge, the Newark saw a 20% reduction in offenses. She also stated that the city of Camden experienced its initial homicide-free summer since 1974 with no murders.

Connection to Donald Trump

Habba, 41, first joined the former president's legal defense in recent years. She went on to defended her client in his business records case in 2024, leading to his guilty verdict on dozens of charges of falsifying business records.

Prior to Habba took on the federal prosecutor position, Trump had revealed he was selecting her as his presidential counsellor if re-elected, describing Habba as a steadfast ally and a "tireless advocate for justice".
