High Court Upholds Redrawn Texas House Electoral Boundaries.

Via an unattributed ruling, the nation's top court cleared the way for Texas to use a revised congressional district plan that could add as many as five additional conservative-tilting districts. The six-to-three ruling, handed down on Thursday, upholds a petition by the state to overturn a district court's injunction that had rejected the boundaries in November.

Justices' Reasoning

The lower court erroneously placed itself into an active primary campaign, causing significant confusion and disturbing the sensitive equilibrium in elections, the order stated in explaining its ruling.

That lower court had earlier ruled that Texas had likely classified voters based on their race – a method known as unconstitutional racial sorting – when it enacted the boundaries. It had instructed the state to employ the maps created after the most recent national count for the next year's election.

Strong Dissenting Opinion

With a sharply worded dissent, Justice Elena Kagan objected to the court's decision. She stated that it disregarded the work of the district court, observing that its opinion was actually authored by a judge selected by former President Donald Trump.

We are a higher court than the district court, but we are not a better one when it comes to making such a fact-based decision, Kagan argued in a opinion supported by Justices Sonia Sotomayor and Ketanji Brown Jackson.

She continued, This court's stay ensures that Texas's redistricting plan, with all its enhanced favoritism, will control next year's elections. And it means that many Texas residents, for no good reason, will be sorted in electoral districts based on their race. And that result, as this court has declared consistently, is a breach of the constitution.

Countrywide Map-Drawing Fight

The court's action is part of a national battle over the redistricting of electoral maps. Texas is a crucial component in campaigns to alter the U.S. House map to bolster a narrow Republican majority. Usually, redistricting takes place after a ten-year survey. Yet the move by Texas Republicans to proceed with a bold mid-cycle redistricting earlier in the summer sparked a series of events among other states.

GOP lawmakers in including North Carolina and Missouri have also enacted new maps that might create a number of additional GOP-friendly seats. Democrats, meanwhile, have countered with their own plans in including California and Virginia, which could offset those projected gains.

Political Reactions

Lone Star State top lawyer praised the supreme court ruling. In a comment, he said the order defended Texas's prerogative to draw a map that ensures representation supportive of Republicans. Our state is leading the charge to reclaim the nation, one district and one state at a time, he stated.

On the other hand, opposition party officials lamented the outcome. It's incredibly disappointing that the Court has rubber stamped a map enacted by Texas Republicans which, simply put, is an extreme, racially gerrymandered map, said the chair of a major Democratic campaign committee.

A top Democratic figure argued the court had once again eroded its credibility by approving a race-based map. Tonight's ruling by far-right justices on the supreme court is further proof that the extremists will do anything to rig the midterm elections. The gerrymandered Texas congressional map is a partisan and racially discriminatory power grab designed to subvert the will of the voters – particularly in Black and Latino communities, he stated.
